A Brazilian influencer, weighing 460 pounds, has taken action against a gym that allegedly denied him membership due to his size, citing concerns over safety. Júlio Otávio Miranda da Silva, 35, made headlines when he reported the denial to the police after being turned away from a trial swimming session at Academia Horizon, located in São Paulo.

On January 22, Júlio recounted his experience, stating, “I went to take a trial class… and today they called me to say they cannot accept my registration as a member.” His feelings of frustration were compounded by the gym’s classification of him as a “health and safety risk.” Following this, he decided to escalate the issue, filing a complaint with local authorities, which has since been registered as a “non-criminal” case.

Authorities have indicated that the gym’s conduct may violate consumer laws in Brazil that protect individuals from discriminatory practices and unjustified refusals of service. They have advised Júlio to consider civil action in order to address what they perceive as an abusive treatment under consumer protections, which aim to ensure fairness for all clients.

In response to the incident, Academy Horizon released a statement explaining their rationale. They noted that although Júlio participated in a trial swimming class, staff observed circumstances during the session that raised safety concerns. The gym emphasised their decision was founded not on prejudice but rather on responsibility and concern for Júlio’s wellbeing. “After the class, we had an open conversation and explained that, under the current conditions of our facilities, it was not possible to continue with the enrolment without risking the participant’s safety,” the statement read.

Despite this justification, Júlio contests that his only difficulty during the swimming class was exiting the pool, which he described as requiring additional effort. “I made it clear to them that it wasn’t a problem,” he asserted, expressing his disappointment with the gym’s decision to deny his membership.

The influencer, known as “mamuteofficial” across social media platforms, boasts a following of 1.8 million on Instagram and 915,500 on TikTok. He has been transparent about his weight loss journey, during which he has successfully lost over 220 pounds. Given his substantial online presence, the story of his gym experience has resonated widely, garnering significant public support.

Social media reactions have poured in from fans and fellow influencers, who stand by Júlio’s side. Carlos Secco, another influencer from Santo André, took to social media to share a video that featured Júlio outside a police station. In his post, he condemned prejudice in any form, calling for an increase in empathy and compassion within society. “More than ever, we need empathy, love and giving to others… caring for people, looking at each other with humanity and social responsibility,” he stated.

The response from supporters has been overwhelmingly positive, with many encouraging Júlio to remain strong and resilient. Comments such as “I’m rooting for you!” and praise for his perseverance in light of adversity exemplify the community’s backing.

For instance, the introduction of nearly 5,000 extra-wide seats at stadiums was intended to ensure that fans could enjoy the games comfortably, a reflection of how Brazilian law views obesity as a disability.

In the wake of his unfortunate experience at the gym, Júlio continues to advocate for larger bodies and promote acceptance while documenting his journey online. His story serves not only as a personal narrative of resilience but also highlights the need for ongoing dialogue regarding health, body image, and consumer rights within Brazilian society.
