Full Story

A British father will be asked to enter a plea in court regarding charges related to the death of his two-year-old son, who fell from a hotel window in Paphos, Cyprus. The incident occurred on July 12 when the child reportedly fell 33 feet from a fourth-floor window at the King Evelthon hotel.

The 37-year-old man from Essex faces charges of causing death by a rash, reckless or dangerous act after sitting his son on a window ledge, mistakenly believing it was closed. Despite efforts by his legal team to dismiss the case, the Cypriot Attorney General has confirmed that legal proceedings will continue, and the father is expected to plead not guilty.

In August, a judge permitted him to travel back to the UK to attend his son’s funeral after posting bail of £25,750. Local opinion is reportedly divided on the appropriateness of his eight-day incarceration following his arrest before bail was granted.

Several legal and police sources in Cyprus have suggested that the father may have been treated unusually harshly given the circumstances. A police source indicated a belief that the authorities were “over-zealously” adhering to legal procedures without sufficient empathy for the family’s grief. A diplomat stated that the local justice system is aware of its scrutiny and noted that a more lenient approach would be beneficial.

The treatment of the father has drawn additional attention, with a judicial source remarking on the absurdity of a grieving parent being viewed as a criminal. Discussions surrounding the safety of the hotel environment have arisen, particularly the open window from which the child fell. Observations made at the hotel revealed that the window lacked safety measures, raising concerns among local residents and expats about health and safety standards on the island.

One Brit expat expressed disbelief that no safety precautions had been implemented for the sliding window, stating, “They should have done something to make the window safer.” Another former prosecutor reflected on the different attitudes towards health and safety in Cyprus compared to the UK, highlighting ongoing issues with safety at the hotel.

What this means for your site

This tragic incident highlights critical gaps in safety management, particularly regarding window safety in hotels. In the UK, the Health and Safety at Work etc. Act 1974 mandates that employers ensure the health and safety of their employees and others affected by their activities. In addition, the Management of Health and Safety at Work Regulations 1999 requires risk assessments to be conducted for work environments, which would include the safety of hotel facilities. It is evident that a thorough assessment was lacking here, leading to a dangerous environment for children.

To prevent similar occurrences, hotel operators must implement concrete measures such as installing window restrictors or locks that limit how far a window can be opened, particularly in guest rooms on higher floors. Regular safety audits and training for staff on the importance of maintaining safe environments can enhance compliance with health and safety standards. Furthermore, awareness campaigns about potential hazards in accommodations should be introduced to inform guests, especially parents, about safety features within their lodgings.
