  • Government plans to consult on new legislation for patient safety

Full Story

MPs have expressed their dissatisfaction with the Government’s slow response to the Women and Equalities Committee (WEC) report on cosmetic surgery reforms, highlighting concerns regarding patient safety. The committee warned that delays in implementing a licensing system for non-surgical cosmetic procedures are exacerbating risks to patients. Members of Parliament voiced their disappointment over the lack of action taken against unqualified practitioners.

In February, the WEC called for an immediate ban on certain high-risk procedures, including the liquid Brazilian butt lift and liquid breast augmentations, from high streets. The committee also recommended that all practitioners performing invasive surgical cosmetic procedures possess specialist training and appropriate board certification.

During discussions, the committee heard of numerous cases involving patients who suffered serious complications, including sepsis and the need for corrective surgeries following poorly performed cosmetic procedures. Evidence was presented about the failure to protect the public from unregulated operators, with accounts of patients facing pressure to pay for surgeries upfront and encountering aggressive behaviour when expressing concerns about their treatment.

Interim committee chair Christine Jardine, a Liberal Democrat MP, stated, “MPs are deeply disappointed by this significant delay. It leaves important recommendations unaddressed and patients’ safety at significant risk.” She emphasised the ongoing issue of high-risk procedures being conducted by unqualified individuals in unsafe environments, adding that the government’s lack of timely action is prolonging these safety risks. Jardine welcomed the prospect of a licensing system but insisted on the need for a quicker regulatory response, particularly in areas of high risk.

A campaign led by The Mirror is advocating for stricter regulations on cosmetic surgery, pushing for procedures such as liposuction, surgical face lifts, and surgical eye lifts to be exclusively performed by qualified surgeons on the General Medical Council specialist register. They are also calling for beauty clinics offering non-surgical treatments to hold malpractice insurance as a legal requirement.

In a response, a Department of Health and Social Care spokesperson reassured the public of the Government’s commitment to safety from rogue practitioners. They noted that new measures are being developed to ensure only qualified healthcare professionals are allowed to conduct high-risk cosmetic procedures. The spokesperson stated, “We will soon be consulting on this new legislation including restricting all cosmetic surgery to doctors who are regulated to strict standards set by the General Medical Council and who work from Care Quality Commission regulated settings.” They advised those considering cosmetic procedures to verify the provider’s qualifications and insurance, and to be cautious of treatments that seem overly inexpensive.

What this means for your site

In response to the ongoing issues surrounding cosmetic surgery and the lack of oversight regarding non-surgical procedures, one significant change would be implementing immediate regulatory measures to ensure that only qualified practitioners perform these services. The Government’s failure to enact a licensing system has left patients vulnerable, highlighting a critical need for adherence to the Health and Safety at Work etc. Act 1974, which mandates employers to ensure the health, safety, and welfare of their employees and others affected by their activities. This includes the necessity for practitioners in health-related fields to be adequately trained and certified.

Effective steps a site could take include establishing rigorous pre-qualification assessments for all personnel performing aesthetic procedures and implementing strict verification processes to ensure compliance with the Management of Health and Safety at Work Regulations 1999. Furthermore, instituting mandatory malpractice insurance requirements for practitioners conducting cosmetic interventions would protect clients and enhance industry accountability. By prioritising these measures, sites can safeguard patient welfare and mitigate the risks associated with unregulated practices.
