Full Story

A hotel proprietor has appeared in court facing several charges related to health and safety violations connected to the tragic death of the fiancé of a former reality television star. The incident, which occurred nearly two years ago, involved the partner of Jaymi Hensley, who gained recognition on the ITV talent show, The X Factor, in 2011 as part of the boyband Union J.

Olly Marmon, a stylist and hairdresser, fell from a window on the third floor of the Hind Hotel in Wellingborough, Northamptonshire, resulting in fatal injuries. This incident took place in August 2024, shortly before Hensley and Marmon were set to celebrate their marriage after being together for about 15 years. Emergency services responded promptly to the scene, arriving shortly after 11:30 PM, but Marmon succumbed to his injuries despite their efforts.

Marcus de Lannoy Holden, aged 57, who hails from Shennington in Banbury, Oxfordshire, appeared in Northampton Magistrates’ Court in July. The case arises from allegations that the hotel’s windows presented a hazard to its guests. According to court documents, Holden is charged with failing to ensure that windows, which had the potential to be opened by guests, were adequately secured to prevent any risk to health and safety.

Specifically, one of the charges states that he failed to ensure “that windows capable of being opened were likely to be opened, closed or adjusted in a manner which did not expose anyone to a risk to their health or safety.” Additionally, he faces accusations of neglecting to carry out required risk assessments relating to the safe operation of all windows in the hotel, compromising safety for patrons and employees.

Holden also stands accused of not ensuring the health and safety of his staff, failing to protect them from potential risks. As the case progressed, Holden did not enter a plea and was granted bail so he could seek legal counsel. The hearing has been adjourned until October, as proceedings continue.

The tragic loss of Olly Marmon has left a profound impact on his family and friends. In the wake of his passing, his mother, Julie, alongside stepfather Steve Peacock, released a heartfelt statement expressing their devastation. “Words cannot express the devastation and heartbreak we are feeling,” Julie said. She described Oliver as a “caring, loving, quiet” individual who consistently prioritised the well-being of others. Her tribute highlighted the many lives he touched, stating, “Everyone he met fell in love with him.”

Marmon’s brother, Ben, also shared a poignant reflection on their relationship, describing Olly as his “little ray of sunshine.” He said, “You are my best friend. You radiate joy and excitement to all around you.” Ben conveyed how Olly brought happiness and creativity to their lives, illustrating that his brother was not only cherished for his personality but also for the positive influence he had on those around him. “Never underestimate the difference you made and the lives you touched,” Ben added, emphasising the profound sense of pride he felt for Olly.

Jaymi Hensley, who rose to fame during his time on The X Factor alongside fellow bandmates Jamie Hamblett, George Shelley, and Josh Cuthbert, is grappling with the loss of his partner. The couple’s imminent wedding was tragically cut short, leaving a community in mourning for a vibrant life that ended far too soon.

As the legal proceedings commence, the wider implications of this case raise concerns about the enforcement of health and safety regulations within hospitality venues. Safety standards are crucial in protecting guests and employees alike, ensuring that preventative measures are in place to avert similar tragedies in the future.

The local community has been affected deeply by the incident, with many expressing their condolences to Marmon’s family. The hotel where this tragedy occurred is now under scrutiny, with increased scrutiny on how such establishments manage safety protocols related to structural features, such as windows.

The case has also spurred discussions about the responsibilities and liabilities that hotel owners hold in relation to guest safety. The balance between providing a comfortable stay and ensuring robust safety measures is vital in maintaining public trust in the hospitality industry.

As this case proceeds through the legal system, it stands as a sobering reminder of the potential risks associated with faulty safety measures and the tragic consequences they can lead to. The hope for improvement in safety standards is echoed in the community’s desire for justice, not only for Olly but as a safeguard for future guests.

With the court set to reconvene in a few months, all eyes will be on the proceedings, which aim to address the accountability of those in positions of responsibility in the hospitality sector. The legacy of Olly Marmon will not only remain in the hearts of his loved ones but may also act as a catalyst for change that improves safety for all.

Our Thoughts

The tragic incident involving the death of Olly Marmon highlights significant failures in health and safety management at the Hind Hotel. To avoid such tragedies, the hotel management should have implemented robust safety measures for openable windows, ensuring they were fitted with proper restraints or guards. Compliance with the Health and Safety at Work Act 1974, which mandates employers to ensure the health and safety of all employees and visitors, is critical.

Additionally, the alleged failure to undertake a risk assessment as required by the Improvement Notice contravenes Regulation 3 of the Management of Health and Safety at Work Regulations 1999. Regular safety audits focusing on potential fall hazards could have identified and mitigated risks associated with window openings.

The case serves as a reminder of the necessity for thorough health and safety training and the importance of immediate corrective actions when risks are identified. Establishing a culture of safety awareness among staff and conducting frequent safety checks can prevent similar incidents in the future.
